Social Legislation & Law for the Elderly An overview of legislation that pertains to senior citizens is studied and how these laws impact on the lives of the elderly.  We cover the Social Security Act and the entitlements included such as Social Security, SSI, Disability, Medicare, Medicaid.  We learn about all of the programs that tangentially are related to these benefit programs.  We then go on to  Long Term Care and the legislation that regulates it, Guardianship, and Right to Refuse Medical Treatment. 3 Every fall semester None 1990 20 Assistant Clinical Professor
Elder Law Clinic The in-house clinical utilizes the information learned in the above course by directly working with seniors at senior citizen centers and at residential facilities.  They are assigned a job placement and do intake and interviewing of clients on a one on basis.  They then handle cases through to completion (when possible) and learn how to work with clients from the very beginning of a case to the end.  They will deal with most legal problems and also write wills and health care directives. The students represent clients at administrative law hearings as well.  All of the services are free and are under the supervision of their professor.  In addition we give educational presentations and workshops to both seniors, themselves, and also for service providers like hospital social workers, in-home service providers, and protective service social workers for just a few examples. 3 Every spring semester Social Legislation & Law for the Elderly 1981 8 Assistant Clinical Professor
Lastly, we go on fieldtrips and see, firsthand, some of the offices and courtrooms where lawyers must work.  Examples are going to a guardianship hearing or disability hearing, go to the register of wills office,  or visiting a skilled nursing home and meeting with all of the people who run the facility.and meeting with all of the people who run the facility.

Elder Law Research Project In this class, students research and write a substantial annotated bibliography on an issue related to elder law, for publication on the National Elder Law Network (NELN.org). NELN is a website hosted at William Mitchell devoted to creating public awareness of issues affecting the senior population. The bibliography will include references to print and Web-based materials. Students will meet once as a group at the beginning of the semester; thereafter, by appointment with the professor.

Feminist Theory, Law and Aging This course will explore the themes of feminist theory as they relate to issues of gender and age, and show the connections between these themes and topics such as the family, employment discrimination, and violence against women. Readings will include essays on feminist legal theory, articles on the demographics of aging and their effect on social policy, and fiction (short stories and novels) about growing older. Classes will be conducted mostly through discussions.

Elder Law Workshop: Advising the Elderly Client This course is an optional one-credit supplement to the 2-hour Elder Law course. This workshop aims to broaden students’ understanding of elder law issues and introduce them to issues associated with drafting legal documents for an older client, such as special ethical considerations and cultural issues associated with aging.

The workshop will focus on a set of skills not often taught in law school: translating the law for lay people, presenting legal concepts to lay people, and drafting sample documents. These skills are important to lawyers whose practice involves training of groups of lay people.

Students may have the opportunity to work with elder law specialists and and advocates for the elderly community in the Twin Cities.

Students will write a short expository article, suitable for a lay audience, on a topic pertaining to elder law, give an informal presentation relating to the topic to a seniors’ organization or other gathering of older persons, and draft documents relating to subject matter of the paper/presentation. For each project, there will be feedback on a preliminary product.
1   Elder Law Survey or Elder Law I or Elder Law II      
Elder Justice and Policy Keystone Students in the Elder Justice and Policy combine an external placement with an elder justice organization (e.g., a legal aid organization serving seniors, an elder advocacy project, or a senior rights organization) with an intense seminar that will involve, inter alia, preparing a substantial research paper addressing an issue or area of significant state or national interest implicating the legal needs of the elderly population, discussing advanced topics in elder law (e.g., advanced ethical issues in an elder law practice), and investigating the use of technology in the practice of elder law and elder advocacy. Students who wish to enroll in this course must apply to work on a specific project (or projects) for a specific organization , and will be placed with that organization for the semester in which they are enrolled in the class. Projects typically entail drafting legislation and working towards its passage in the state legislature or at the national level, developing self-help resources for seniors on specific areas of interest, or conducting empirical research on elder justice issues. Projects will be clearly defined from the outset, with the nature of the student´s responsibilities set out prior to the student´s placement within the organization. The total credits awarded for the course will depend on the specific project to which the student is assigned.
     
Enrollment in this class is by application only.  No-drop policy applies.  Class may be used to satisfy the long paper requirement.

Older Americans Law Project The Older Americans Law Project (OALP) partially operates under a Title III-B federal grant.  This grant allows the Clinic to provide free legal service to persons 60 or older.  Students learn lawyering skills handling a caseload, making presentations in the community, and attending classes and docketing meetings.  Class focuses on relevant elder law topics: Professional Responsibility, Community Resources, Wills, Durable Power of Attorney, Advance Directives, Do Not Resusitate Orders, HIPPA, Guardianships, consumer fraud and predatory lending, real property, consumer debt issues, and probate. 3 or 4 Every semester Student must have completed the first year curriculum.  Professional Responsibility, Evidence, and DET are strongly suggested.   8-10 Clinician

Elder Law Course addresses specific elder law issues each class.  Students have assigned readings and much of the class time is spent in a discussion format and some specific problem solving.  Students are asked to make one 10-minute oral presentation on an aging issue; to complete one drafting assignment (usually a general durable power of attorney); senior related activity or pro bono (working with a volunteer lawyer in an elder law clinic, shadowing a long-term care ombudsman, Meals on Wheels, etc.) for one day and writing about the activity; and, writing or producing a specific project.  Graduate students from such disciplines as social work may also choose to enroll. 2 Every other year Open only to second and third year law students.  Graduates from other disciplines may also enroll.   15
